Abstract
Objectives: This study aimed to collect the jurisprudential rules and controls related to the contract of donations (loans), analyze these rules and controls and consider their contemporary jurisprudential applications. It sought to understand how to organize these donations, especially loans and deal with them according to the Islamic jurisprudential rules and controls. Methodology: The study relied on the following research methods: The inductive method was used to collect evidence from various jurisprudential sources, the descriptive method was used to present the rules and controls in detail, the analytical method was used to analyze the rules and explain their meanings, and the applied method was used by providing applied examples of the jurisprudential rules and controls related to loans. Conclusion: The study concluded that the loan contract in Islamic jurisprudence is characterized by a precise system based on specific rules and controls that achieve the interests of the members of society. The study showed and emphasized the importance of intention in determining the ruling on the loan contract. The study also demonstrated the role of custom in organizing the loan contract and the importance of this custom as a condition commonly known in the contract. Finally, the study recommended including donation contracts in the educational curricula of religious and academic institutions. The study also recommended encouraging researchers to conduct more studies on the applications of jurisprudential rules in contemporary society.
