Hajj Permit and Its Impact on Achieving the Objectives of Islamic Law: A Juristic and Objective Study

Abstract
Objectives: The study aims to clarify the Islamic legal ruling on Hajj permits and the extent to which organizing the performance of Hajj rituals through such permits is legitimate in light of Islamic legal principles and objectives, while highlighting their role in achieving public benefits and preventing harms. Methods: The study adopts the inductive approach by examining the statements of jurists and the relevant jurisprudential and legal principles related to the subject. It also employs the analytical approach to study these statements and applies them to the issue of Hajj permits, while benefiting from the maqāṣid-based approach in explaining their role in achieving the objectives of Islamic law. Conclusions: The study concludes that the Hajj permit is neither a devotional condition for the validity of Hajj nor one of its pillars; rather, it is a legitimate organizational means for achieving public interest and preserving the welfare of pilgrims. Compliance with it falls under obedience to the ruler in matters of righteousness. The study also demonstrates that Hajj permits contribute to achieving the objectives of Islamic law, particularly the preservation of religion, life, wealth, and intellect, through organizing the ritual, regulating the number of pilgrims, and preventing chaos and harm. The research recommends giving greater attention to studying contemporary jurisprudential issues related to Hajj through an approach that combines jurisprudence and maqāṣid, increasing awareness of the importance of adhering to Hajj permits, and warning against forms of fraud and manipulation due to their negative legal and social consequences.
