Abstract
This study addresses a question that has arisen in the contemporary jurisprudential actual status, which is about the author’s right to protect his electronic writings, which have become of financial value. Such protection is to prove to the owner’s title and his right to act. This made it necessary to approve protection and prevent abuse, fraud and the exploitation of the efforts of others. This has positive effects such as preserving interests and achieving justice, which in turn contributes to the advancement and progress of nations. The study has a number of conclusions, the most important of which are: the infringement of the author’s electronic rights by exploiting them and benefiting from them is illegal and is like confiscate people’s property unjustly, and this is forbidden. The basis of Islamic Sharia law and its foundation is to establish justice among people and to prevent injustice and infringement of the rights of others. The study made a recommendation to the specialists and scholars to enact a discretionary punishment that commensurate with the crime of infringement upon the rights of electronic authors and inventors. It should take into account the size of the felony and the condition of the offender and the victim.
