Abstract

Objectives: The purpose of this study is to indicate and examine the legal regulation of the contractual responsibility of the provider of electronic documentation in Jordanian legislation and some comparative legislation, as well as to address some practical and practical problems related to the subject matter, including the implications of breaches of the contractual responsibility of electronic documentation. Methods: The study adopted the inductive approach using the extrapolation of legal texts on the subject of research in accordance with Jordanian legislation, as well as the analytical approach. The researcher analysed and described the legislative and doctrinal positions and international conventions relating to the subject matter of the research, and the prescribed approach of establishing the legal nature of the civil liability of the electronic documentation agency. Results: The study found a number of findings, the most important of which were the lack of clear and explicit texts establishing the contractual responsibility of the electronic documentation entity; It was left in the organization of the general rules, despite the privacy of the electronic notary and its work of a special nature. These rules are insufficient to regulate such a problem because of the special nature of the electronic authenticator in the event of non-compliance with the agreed duties. Conclusions: This study recommended that Jordanian legislators should provide detailed provisions on the regulation of the contractual liability of the electronic notary, due to the nature of its work.
