Electronic Signature (A comparative Analytical Study in Light of the UNCITRAL Model Law on Electronic Signatures and Jordanian Legislation)

Abstract
Objectives: This study aims to explain the concept of electronic signature, its characteristics, conditions, and functions, to explain the legal effects resulting from the use of electronic signatures in various transactions, the scope of acceptance of electronic signatures, and to explain the impact of the UNCITRAL Model Law on Electronic Signatures on Jordanian legislation. Methods: The study relied on the analytical approach, through analyzing the legal texts related to electronic signatures, as well as analyzing and describing the opinions of jurists on this subject, and the comparative approach, through comparing the different legal texts with each other. Conclusions: The most important results and recommendations reached by this study are: that the electronic signature is one of the basic requirements to ensure the reliability of electronic transactions, as the electronic signature leads to increased trust and security in electronic transactions, the necessity of harmonizing local legislation with international legislation, as the Jordanian legislator must issue a special law related to electronic signatures and address all matters related to it in this law and be compatible with the provisions of the UNCITRAL Model Law on Signatures.
