Judicial Expertise and its Evidentiary Weight in Jordanian Legislation

Abstract
Objectives: The study aimed to clarify the concept of judicial expertise and to identify the legal nature of judicial expertise from both a jurisprudential perspective and the standpoint of Jordanian legislation. Methods: The study adopted the descriptive and analytical approach by describing and analyzing the legal texts regulating judicial expertise in Jordanian legislation. Results: The study arrived at a number of findings, most notably that the expert's role is limited to clarifying certain matters that fall outside the judge's area of specialization, such as issues related to technology. The judge retains the final authority in deciding whether to rely on the expert's report, as the ultimate responsibility for adjudicating the case rests with the judge. Conclusions: The study recommended that the Jordanian Code of Civil Procedure include specific provisions governing the dismissal of experts, since current articles focus on judges and overlook the functional and legal distinctions between the two roles. Given the differing legal positions of judges and experts, the researcher emphasized the need for tailored legislation to regulate expert dismissal more accurately.
